Welcome to CURATO ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the services provided by CURATO, LLC, a Florida Limited Liability Company doing business as CURATO, through our website www.curato.us ("Site") and related communications.
By engaging CURATO's services or accessing our Site, you agree to these Terms. If you do not agree, do not use our services.
1. Services Provided
CURATO offers luxury travel advisory services, including bespoke itinerary planning, air and hotel booking, and curated experiences (collectively, the "Services"). All Services are tailored to our clients and may involve the coordination and arrangement of third-party travel suppliers.
2. Role as Intermediary
CURATO acts solely as an advisor and liaison between you and third-party providers, including airlines, hotels, tour operators, transportation companies, and other service providers ("Suppliers"). We do not own, operate, or control any Suppliers and are not responsible or liable for their acts, omissions, or performance.
3. Planning Fees & Payment Terms
To initiate planning, CURATO requires a planning fee and a 50% non-refundable deposit based on the estimated cost of your itinerary. The remaining balance may be due in full or in part, depending on the payment structure agreed upon for your itinerary. All payments must be made in accordance with the invoice or agreement provided to you.
4. Cancellations & Refunds
All cancellations and refund policies are governed by the terms and conditions of the relevant Supplier. CURATO will assist in communicating with Suppliers but is not responsible for enforcing their policies. It is your responsibility to review and understand the cancellation and refund terms of each Supplier.
5. Travel Documentation and Health Requirements
You are solely responsible for ensuring that all travelers in your party possess valid passports, visas, and other required documentation. You are also responsible for complying with health and vaccination requirements for all destinations.
6. Travel Insurance
CURATO strongly recommends that all clients purchase comprehensive travel insurance to protect their investment against unforeseen events. We are not an insurance provider or broker, and our team cannot advise on specific coverage scenarios. Please contact your chosen insurance provider directly with any questions.
7. Changes and Modifications
Itineraries may be subject to change by Suppliers due to weather, mechanical issues, or other factors beyond CURATO's control. CURATO is not liable for delays, schedule changes, or cancellations by any third party.
8. Limitation of Liability
CURATO shall not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability, or otherwise, arising from your use of our Services or any act or omission of any Supplier.
9. Indemnification
You agree to indemnify and hold harmless CURATO, its affiliates, employees, and agents from any claims, liabilities, damages, or costs (including reasonable attorneys' fees) arising from your use of our Services or violation of these Terms.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising out of or related to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
11. Updates to Terms
CURATO may revise these Terms at any time without notice. The updated version will be posted on our Site and will take effect upon posting. Continued use of our Services after changes constitutes your acceptance of the revised Terms.
